The CARES Act

Part 103), FinCEN may bring an enforcement action for violations of the reporting, recordkeeping, or other requirements of the BSA. Driver’s license suspension. If a child is adjudicated delinquent for the unlawful act of using, possessing, selling or distributing a controlled substance the juvenile court shall: (a) if the child possesses a driver’s license, issue an order suspending the driver’s license of the child for at least 90 days but not more than 2 years.

On Friday, March 27, the President signed the Coronavirus Aid, Relief and Economic Security Act (CARES Act) into law. As guided by the Department of Labor, these are the various programs available to eligible Nevadans under the CARES Act.

Suspend Work Search Waiver

As instructed by the Governor, DETR's Employment Security Division, has waived work search requirements beginning 03/15/20 for all claimants in acknowledgment of the unavailability of unsuitable work resulting from the Covid19 public health crisis temporary shutdown of non-essential businesses.

Additionally, claimants will not be required to register for employment services in-person at Nevada JobConnect Offices or any other local employment offices within their area until these offices have reopened. Out of state claimants will not be required to register for employment services in their state until further notice. (NRS 612.375, NAC 612.170).

Suspend Waiting Period

As instructed by the Governor, the 7-day waiting period (i.e., the waiting period of time between applying for and receiving unemployment insurance benefits) has also been suspended to ensure claimants receive their benefits as quickly as possible.

Able & Available Issues

An Administrative action has been put into place to resolve or remove most Able & Available issues created beginning 03/15/20. While not all issues will be resolved, those that are cleared and have no other issues requiring adjudication on the claim will be allowed to proceed with processing and payment on the claim.

Deductible Income Issues

Claims with a Deductible Income issue will not be paid for a one-week period beginning the effective date of the claim. Issues will still be adjudicated and adjusted accordingly, including any FPUC payments that the claimant may be entitled to, and payments will be paid starting the second week of the claim, if all other eligibility requirements are met. This action affects deductible income issues including separation pay issues such as vacation pay, severance pay, wages in lieu and paid vacation. This action does not apply to pension pay issues as these issues do not fall within the separation pay category.

This program provides unemployment insurance benefits support for otherwise ineligible workers, including self-employed. PUA is available retroactively from February 2, 2020 through December 26, 2020 and provides up to 39 weeks of benefits to qualifying individuals who do not qualify for regular unemployment insurance (UI), Pandemic Emergency Unemployment Compensation (PEUC) or State Extended Benefits (SEB) but are otherwise able to work and available for work except they are unemployed, partially unemployed, or unable or unavailable to work due to a COVID-19 related reason. Benefits are payable for weeks you were previously out of work, even if you have since returned to work.

Pandemic Emergency Unemployment Compensation (PEUC)

This program provides an additional 13 weeks of regular unemployment insurance benefits for eligible claimants whose claims have been exhausted (i.e., all eligible unemployment insurance funds have been paid out).

This program provides an additional $600 to each week of regular unemployment insurance benefits or to the Pandemic Unemployment Assistance program weekly insurance benefits (PUA) for otherwise ineligible workers (see next paragraph for further details). FPUC benefits to eligible claimants will be paid for the period starting the week ending April 4, 2020 thru the week ending July 25, 2020 for a total potential of 17 weeks, based on each claimants’ eligibility.
